The federal Bankruptcy Code provides a number of different methods for Americans to settle their debt issues, both for businesses and individuals. For an individual looking for debt relief, the two most common options are to file for:

  • Chapter 7 bankruptcy — This is the most commonly used type of bankruptcy for individuals who pass the means test and qualify for their debts to be discharged. Under this Chapter 7, the filer’s debts are classified as either exempt or nonexempt. Exempt debts can’t be discharged through bankruptcy and include school loan payments, taxes and child support, and nonexempt debts are eligible to be dismissed. Once the process is finished, most of your general unsecured debts (such as credit cards and medical bills) are eliminated and you are not required to pay back balances.
  • Chapter 13 bankruptcy — This chapter is designed for people who have a regular income, with enough left over each month to pay back at least a portion of their debts through a repayment plan. Chapter 13 allows you to keep your property and it stops collection actions until a manageable repayment plan can be established.
